1 Agreement & eligibility

By creating an account or using LEAF, you agree to these Terms. You must be 21 or older and able to form a binding contract. If you don't agree, don't use LEAF. These Terms include a binding arbitration agreement and a class-action waiver in §15, which affect how disputes are resolved.

2 What LEAF is (and isn't)

LEAF is a personal record-keeping and reference application for documenting cigars you have chosen to consume — a lifestyle and journaling tool. LEAF does not sell tobacco, facilitate the purchase of tobacco, provide retailer or affiliate links, or provide medical or health advice. "Where bought" and price fields are informational notes for your own records, never a transaction.

3 Your account

You sign in with Apple. You're responsible for activity under your account and for keeping access to your Apple ID secure. Tell us promptly of any unauthorized use.

4 Your content & the three licenses

Your data lives in three forms, and you grant a different, limited license for each:

(a) Your private journal. Your logs, ratings, reviews, tasting notes, and photos are yours. You grant LEAF a non-exclusive, worldwide license to host, back up, process, and display this content to you solely to operate the service. We do not make it public or share it — except as de-identified aggregate insights, and only if you opt in (see (c)).

(b) Cigar facts you add to the catalog. If you add a cigar the catalog lacks, its objective facts (brand, line, wrapper, origin, size) enter LEAF's shared catalog. For those facts you grant LEAF a perpetual, worldwide, transferable, sublicensable, royalty-free license to store, reproduce, standardize spelling and formatting, correct inaccuracies, merge duplicate entries, translate or restructure, display to other users, and remove inaccurate or inappropriate entries. Facts about a product are generally not owned as creative expression; any original description or photograph you add stays your content under (a), and you confirm you have the rights to it.

(c) Aggregate cigar insights. Only if you separately opt in ("Share cigar insights"), you permit LEAF to include your ratings and logged cigars in the de-identified, aggregated statistics described in the Privacy Policy §6 — never your reviews, photos, individual logs, or precise location. This permission is separate from these Terms; withdrawing it stops use of your information in newly created reports.

5 The catalog & cigars you add

LEAF's cigar catalog is shared reference data. If you add a cigar the catalog is missing, its factual details enter the shared catalog for everyone (see §4(b)); your opinions (rating, review, tasting notes, photo) stay on your private log and are never written into the shared catalog.

6 Brands & trademarks

Cigar brand names, product-line names, logos, bands, and packaging are the trademarks and property of their respective owners. Their appearance in LEAF is nominative reference for journaling and does not imply any sponsorship, endorsement, or affiliation; LEAF is an independent record-keeping service. Rights holders may email support@leafcigars.fyi to report inaccurate or infringing catalog material, and LEAF may correct, remove, or modify submitted catalog content.

7 Acceptable use

Don't misuse LEAF: no unlawful use, no scraping or automated bulk access, no attempts to break security or access others' data, and no uploading content you don't have the rights to or that is unlawful.

8 Copyright & DMCA

LEAF respects intellectual-property rights. If you believe content in LEAF (such as a user photo or description) infringes your copyright, send a notice to our designated agent at support@leafcigars.fyi including: identification of the copyrighted work; the material you claim is infringing and where it is in LEAF; your contact information; a statement of your good-faith belief that the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner's behalf; and your signature. We respond to valid notices — including by removing infringing material — and may terminate repeat infringers.

9 Service changes & your data

LEAF may modify, suspend, or discontinue features at any time, and does not guarantee that every catalog record, photo, or journal entry will remain continuously available. Except where immediate action is required for security or legal reasons, if we permanently terminate your account you'll have a reasonable opportunity to export your private journal first — and you can export it anytime in Settings.

10 Our intellectual property & feedback

The LEAF software, interface, design, catalog structure, name, and branding are owned by LEAF and its operator and protected by intellectual-property laws; nothing here transfers those rights to you. If you send suggestions or feedback, you grant LEAF a perpetual, royalty-free right to use them without obligation or compensation.

11 Third-party services

LEAF relies on third-party providers — including Apple (Sign in with Apple), Supabase (data, authentication, storage), and PostHog (analytics) — which operate under their own terms and privacy practices. LEAF is not responsible for those services, and your use of them may be governed by their agreements.

12 Apple App Store

These Terms are between you and LEAF, not Apple, and Apple is not responsible for LEAF or its content. Apple has no obligation to provide maintenance or support for LEAF. Apple is not responsible for any product warranties, whether express or implied; in the event LEAF fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) — to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to LEAF, including product-liability, legal or regulatory compliance, or consumer-protection claims, or any third-party claim that LEAF infringes intellectual-property rights. You must comply with applicable third-party terms (for example, your wireless data plan) when using LEAF. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.

13 Disclaimers & tobacco risk

LEAF is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. Catalog information may be incomplete or inaccurate and is not a guarantee about any product. LEAF is a record-keeping and informational service — it is not medical, health, or safety advice, and makes no representation that consuming cigars is safe or lower-risk than any other tobacco product. Tobacco use is associated with serious health risks. Ratings, tasting notes, catalog data, and aggregate statistics describe user experiences and preferences only.

14 Liability & indemnity

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including certain consumer rights. Subject to that, to the maximum extent permitted by law: LEAF and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits; and total liability for any claim is limited to US$100.

You agree to indemnify LEAF for third-party claims arising from your unlawful conduct, content you upload that infringes or violates rights, your material breach of these Terms, or fraudulent or manipulated ratings — but not for claims caused by LEAF's own conduct.

15 Dispute resolution — arbitration & class-action waiver

Please read this section carefully. It affects how disputes between you and LEAF are resolved and limits how you can seek relief.

(a) Informal resolution first. Before starting a formal proceeding, you agree to email support@leafcigars.fyi describing the dispute and to try in good faith to resolve it informally for at least 30 days.

(b) Binding individual arbitration. Except as stated below, any dispute arising out of or relating to LEAF or these Terms will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.

(c) Class-action waiver. You and LEAF agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

(d) 30-day opt-out. You may opt out of this arbitration agreement by emailing support@leafcigars.fyi within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect the rest of these Terms.

(e) Exceptions. Either party may bring a qualifying claim in small-claims court, and either party may seek injunctive relief in court for intellectual-property infringement or unauthorized access.

(f) Severability. If the class-action waiver is found unenforceable as to a claim, that claim proceeds in court and the rest of this section survives; if the entire arbitration agreement is found unenforceable, disputes proceed in the courts identified in §17.

16 Termination & changes

You can stop using LEAF and delete your account at any time. We may suspend or end access for violations of these Terms. We may update these Terms; if we make material changes we'll surface them in the app, and continued use means you accept them.

17 Governing law & general

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws rules, and — for any dispute not subject to arbitration under §15 — the state and federal courts located in Cobb County, Georgia have exclusive jurisdiction, subject to any non-waivable consumer rights. LEAF may assign these Terms (for example, in a merger or acquisition); you may not assign yours without our consent. If any provision is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. Provisions that by their nature should survive termination — including the content licenses, disclaimers, liability limits, the arbitration agreement, and these general terms — survive.
